LICENSING AGREEMENT
1. Overview
This License Agreement is a legally binding contract between ‘You’, the Customer, and Zilligen Design Studio, Inc., operating under the font foundry "VarsityType". By purchasing a License and downloading the a Font from VarsityType, You agree that You have fully read, understood, and agreed to the terms and conditions of this Licensing Agreement. If you do not agree to this License Agreement, you cannot purchase a License or use Font software from VarsityType.
2. Permitted Use
DESKTOP:
The maximum amount of users (computers or other devices capable of using the font) is determined at purchase. All users must belong to the same company. If you require a license with more than the maximum amount of users stated at checkout, please contact VarsityType.
The License Agreement permits the use of Fonts in both personal projects and commissioned projects. When designing for a client or third-party, then at least one of the following must be done: (a) the Font must be converted to outlines, (b) the client must purchase a license for themselves. The transferring, sub-licensing, renting, lending, or gifting of Fonts is strictly prohibited.
WEBFONT:
You may only use this Font for the website that you control the content of. The maximum amount of page views is determined at purchase. If you require a license with more than the maximum amount of page views stated at checkout, please contact VarsityType.
The License Agreement permits the use of Fonts on a single Website ONLY. You must purchase an additional license if your project meets any one of the following criteria: (a) the Font will be used on more than one Website, (b) the Font will be used on a mobile app, (c) the Font will be used on broadcast television, (d) the Font will be used on printed materials, (e) the Font will be used in a logo design or graphic. The transferring, sub-licensing, renting, lending, or gifting of Fonts is strictly prohibited.
APP:
You may only use this Font for the App that you control the content of. The maximum amount of monthly active users is determined at purchase. If you require a license with more than the maximum amount of monthly active users stated at checkout, please contact VarsityType.
The License Agreement permits the use of Fonts on a single app ONLY. You must purchase an additional license if your project meets any one of the following criteria: (a) the Font will be used on more than one App, (b) the Font will be used on a website, (c) the Font will be used on broadcast television, (d) the Font will be used on printed materials, (e) the Font will be used in a logo design or graphic. The transferring, sub-licensing, renting, lending, or gifting of Fonts is strictly prohibited.
3. Embedding for Production
DESKTOP:
In the event that a VarsityType Font is used in the production of printed material, merchandise, apparel, or commercial products, You may distribute the Font to the printer as long as one of the following is done: (a) the printer deletes the Font immediately after use, (b) the printer purchases a license for themselves. If these conditions cannot be met, the Font must be converted to outlines.
WEBFONT & APP:
This Font may not be used for the production of any printed materials or designs. A separate license must be purchased.
4. Modification
By purchasing a License, You agree to abstain from redesigning, reformatting, adapting, or modifying the Font software. The Font must not serve as a template for the creation of another Font intended for sale. If the Font necessitates modification based on client direction, contact VarsityType as a custom commissioned typeface may be required.
5. Restrictions
The Font must not be used to product hateful, racist, sexist, or otherwise demeaning material.
6. Ownership
You are purchasing a License for usage only and do not own the Font software. All Fonts available on VarsityType are exclusive property to Zilligen Design Studio, Inc. and VarsityType. Any License purchased from VarsityType is exclusive and must not be redistributed.
7. Violation
If the above terms are violated in any way, VarsityType has the ability to terminate the license. If the license is terminated, the Font must be deleted on all devices. Duplicates or copies must not be made.
